TERMS OF SERVICE FOR BLUEBERRY AI

1. Introduction and Agreement to Terms
Welcome to Blueberry AI!
These Terms of Service ("Terms") govern your use of the services ("Services") provided by Adrian Makowski ("Service Provider," "we," "us"). Our Services include the implementation of the Blueberry AI personal assistant system and related consulting services, as detailed in the package you ("Client," "you") have purchased.
By purchasing or using our Services, you agree to be bound by these Terms in their entirety.
2. Description of Services & Packages
We provide our Services in three primary packages: "Momentum Builder", "Growth Accelerator" and "Freedom Architect".
Each package includes the implementation of the core Blueberry AI system, which features:
Your Sovereign AI Engine (Full Ownership): We build the AI system on your own accounts, giving you complete ownership and control. No vendor lock-in.
Central Command Centre (Notion Dashboard): A dashboard for a bird's-eye view of your tasks, ideas and projects.
Effortless Capture via Telegram: The ability to instantly capture thoughts and tasks with a simple text or voice note.
Secure & Scalable Tech Foundation: Professional setup on your Make.com, Google Cloud and OpenAI accounts for reliability and security.
Foundational Situation Audit: A strategic look at your setup to identify your #1 productivity bottleneck.
The specific features of each package are as follows:
Momentum Builder (£197 One-Time Fee): Includes a 1-Hour 'Power Up' Implementation Session for system configuration and initial strategy.
Growth Accelerator (£497 One-Time Fee): Includes everything in Momentum Builder, plus: 10 hours of flexible expert support, multi-user configuration for up to 2 users, a Strategic Business Process Audit and 12 months of priority access to the latest Blueberry AI features and innovations.
Freedom Architect (£997 One-Time Fee): Includes everything in Growth Accelerator with support expanded to 25 hours and multi-user configuration for up to 5 users.
The flexible support hours included in the "Growth Accelerator" and "Freedom Architect" packages can be used for one or more of the following advanced services:
Strategic Business Process Audit: A detailed analysis of the Client's existing workflows to pinpoint the exact operational bottlenecks that are costing time and money.
Custom-Crafted Automation Scenarios: Designing and implementing new automation workflows tailored to the Client's specific tools and unique business processes.
Your AI, Your Rules (Personalised Functionalities): Modifying or extending the core Blueberry AI system with custom features or logic to precisely match the Client's unique way of working.
Custom-Built Clarity Dashboard Tailored To You: Enhancements to the Client's Notion dashboard, including the creation of personalised views, filters and features designed to provide total clarity on projects and tasks.
Uncover Hidden AI Goldmines (Potential Audit):
A deep analysis of the Client's business operations to identify and report on new opportunities for strategic AI implementation and automation.
'Freedom Business' Blueprint (Deep-Dive Strategy) (Available in Freedom Architect package):
A comprehensive, strategic session resulting in a documented, long-term AI and automation roadmap designed to enhance business scalability and operational independence.
3. Beta Launch Acknowledgment
You acknowledge that you are purchasing the Services during the "Beta Launch" phase. This means the Services may be offered at a promotional price in exchange for your valuable feedback, which will be used to improve and refine the Blueberry AI system. While the core system is fully functional, some features may evolve during this phase.
4. Onboarding Process
After purchasing a package, you will receive a welcome email containing a welcome video, a link to our meeting scheduling system and an onboarding questionnaire. You agree to complete and return the questionnaire at least 24 hours prior to our scheduled implementation session.
5. Fees, Payments and Third-Party Costs
Fees for the packages are one-time, payable in advance of the Service delivery.
A Note on Third-Party Platforms & Your Total Control: Our packages cover the expert strategy, creation and integration of the Blueberry AI system. To ensure you have complete ownership and control, we build these assets directly on your own accounts with platforms like Notion, Telegram, Google Cloud and Make.com. This means you are responsible for the direct costs associated with these third-party services. Based on typical usage, we estimate these external costs to be approximately £10-£25 per month. This model ensures you have no vendor lock-in with us, full transparency and the freedom to scale.
6. Scheduling, Rescheduling and Cancellation Policy
Any request to reschedule a booked implementation or consulting session must be made at least 24 hours in advance. Rescheduling a session with less than 24 hours' notice or failing to attend a scheduled session will incur an additional rescheduling fee of £50 to book a new appointment.
7. 14-Day Satisfaction Guarantee & Refund Policy
We are confident in the value our Services provide. We offer a 14-day satisfaction guarantee, effective from the date of your purchase. If within this period you are not satisfied that the Blueberry AI system can work for you, you may request a refund.
The refund amount will be processed as follows:
For the Growth Accelerator and Freedom Architect packages the refund will be calculated as the total package price paid, minus the value of any "Flexible Hours of Expert Support" used, calculated at a rate of
£50 per hour.
For the Momentum Builder package if you are not satisfied after the 1-Hour 'Power Up' Implementation Session, you are entitled to a refund of £147 (the package price of £197 minus the £50 fee for the completed one-hour session).
If all flexible hours within a package have been fully utilised, a fixed goodwill refund of £100 will be issued upon request for the Growth Accelerator and Freedom Architect packages.
8. Client Responsibilities
You agree to cooperate actively during our implementation sessions and to provide the necessary access credentials to your third-party platform accounts (Notion, Google Cloud, OpenAI, Make.com, Telegram) to allow for the configuration of the Service. You are solely responsible for maintaining your accounts with these third-party providers and for paying any associated fees.
9. Intellectual Property
The methodology, concept, name and general structure of the Blueberry AI Service remain the intellectual property of the Service Provider. The configured system, automations and all data processed and stored within your accounts are your exclusive property. We grant you a non-exclusive, perpetual license to use the solutions we implement for you.
10. Limitation of Liability & Disclaimers
We strive to provide the highest quality of service. However, we are not responsible for the performance, availability or any issues arising from the third-party platforms upon which the Blueberry AI system is built. Our liability in connection with the Services is limited to the total amount paid by you for your purchased package. During the Beta Launch, the Service is provided "as is" without express or implied warranties of any kind.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
